The Recast Brussels Regulation: What It Means For Commercial Parties

On 10 January 2015, the Recast Brussels Regulation governing the jurisdiction of courts and the recognition and enforcement of judgments in civil and commercial matters came into effect across the EU. The Recast Regulation repeals and replaces the 2001 Brussels Regulation.

In this Briefing, we discuss what the Recast Regulation means for commercial parties, focussing in particular on the changes made to the jurisdictional rules and how it addresses the issue of “torpedo actions” and the previous confusion surrounding the scope of the arbitration exclusion.
