New Penalties for District Court Health & Safety Offences, March 2011


New penalties for offences prosecuted in the District Court under the Safety, Health and Welfare at Work Act, 2005 (the “2005 Act”) have been introduced by the Chemicals (Amendment) Act 2010, which came into effect on 10 December 2010.

The main purpose of the Chemicals (Amendment) Act 2010 is to amend the Chemicals Act 2008 to bring within its scope new and amended European legislation on chemicals. The amending legislation also, under section 12, makes certain amendments to the 2005 Act, the most significant being the increase to the penalties applicable to summary health and safety offences prosecuted in the District Court.
