For the first time, the responsibilities of certain economic actors in the medical devices supply chain will now be underpinned by EU legislation. In addition to prescribed regulatory obligations, there are slight subtleties in the language used in the new Medical Device Regulations to describe the responsibilities of these economic actors, all of which could have potential consequences in terms of liability. It is important that the various economic actors read these responsibilities carefully and seek legal advice where necessary, particularly when reviewing and drafting agreements.
