Personal Liability - What Are YOU Responsible For?, November 2010

Ever since the passing of the Safety, Health and Welfare at Work Act 2005 (“the 2005 Act”) there is an increased exposure to personal liability of directors, officers and managers under certain provisions of that Act. The 2005 Act has been in force since 1 September 2005. It expanded the duties at law for both employers and employees, setting out a new definition of the term: “reasonably practicable”, placing a greater emphasis on safety management and prevention and increasing exposure to personal liability of directors, officers and managers, specifically under Section 80 of the 2005 Act.
