Dispensation of the Requirement to obtain Non-Resident Declarations From Investors, August 2010

Following the introduction of recent Irish legislation and the subsequent issue by the Irish Revenue Commissioners of implementing measures, an Irish fund will no longer have to obtain non-resident declarations from investors provided that the fund has: (i) put in place appropriate measures to ensure that no Irish resident investors invest in the fund; and (ii) received the written approval of the Irish Revenue Commissioners to implement these measures.
