The aim of the Safety, Health and Welfare at Work Act, 2005 (the “Act”) is to provide a framework and a set of broad general duties and organisational arrangements necessary to achieve better health and safety.

The Act includes a number of general duties for employers and employees, and significantly expands the duties imposed on both. Under the Act, an employee must not be under the influence of an intoxicant, to the extent that he or she is in such a state as to endanger his or her own safety, health or welfare at work or that of others.
