Fraud, White Collar Crime and Asset Tracing

The Practice

We have extensive experience in advising on all aspects of fraud, white collar and regulatory crime, asset tracing, money laundering, dawn raids, bribery and corruption, and whistleblowing.  We advise on the defence of criminal prosecutions and regulatory investigations, including on all aspects of procedure, and on risk management and preventive strategies.  We also provide advice on managing the reputational risk inherent in this area.

Our clients include directors and officers of corporations, national and multinational companies, leading financial and investment institutions, public bodies and private individuals.

Through our work in this area, we have gained significant experience in dealing with the various Irish law enforcement agencies and regulatory bodies, including the Central Bank of Ireland, the Director of Corporate Enforcement, the Data Protection Commissioner, the Revenue Commissioners, the Competition Authority, the Garda Bureau of Fraud Investigations and the Criminal Assets Bureau.

Our experience in this area is not confined to the Irish jurisdiction.  We have been involved in advising on US Department of Justice indictments, US Securities Exchange Commission investigations, mutual legal assistance requests from the US, FBI investigations, applications for oral examination and discovery under the Foreign Tribunals Evidence Act and in US extradition proceedings.  We also have experience dealing with regulatory authorities in numerous EU member states, including Belgium, Germany, Italy and The Netherlands.

Litigation and Dispute Resolution Group partner, Gregory Glynn, is the only Irish member of FraudNet, an international network of fraud litigation specialists founded by the International Chamber of Commerce.  We are also the TRACE Partner Law Firm for Ireland and as such we provide expertise in anti-bribery laws and regulations for the benefit of TRACE’s multinational and intermediary members.
